- The Immigration & Naturalization Service, Dallas, Texas is issuing a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice.This announcement constitutes the only solicitation; quotations are being requested & a written solicitation will not be issued.Solicitation ACD-1-Q-0009 is being issued as a Request for Quotation & is issued as a SMALL BUSINESS SET ASIDE.The quotation document & incorporated provisions & clauses are those in effect through Federal Acquisition Circular 97-22.One or more awards will be made. All of the locations are Border Patrol facilities located in the El Paso Texas area.The Base Period is for 2 months. Each of the three options are for 1 month each for the same locations. Provide pricing for all CLINs and for all performance periods.CLIN 0001: El Paso Sector Headquarters; 0002: El Paso Border Patrol Station; 0003: Ysleta Border Patrol Station; & 0004:Ysleta Traffic Checkpoint. DOL Wage Determination 1994-2511 (Rev 17) is applicable to this requirement.The contractor (KTR) shall provide all management, supervision, labor, materials, supplies & equipment & shall plan, schedule & assure effective performance at the locations.Employees performing work shall be escorted by Govt personnel.The KTR shall provide custodial services & ground maintenance.All interior space for each location shall be free of obvious dirt, debris & dust.All glass surfaces (excluding exterior windows) shall be clean & free of smudges.Furniture shall be free of obvious dust, dirt & debris.Floor requiring a finish shall be maintained at a high luster & free of all marks, dirt & debris & will be maintained according to best trade practices.Wood paneling shall be free of soil substance, dust, streaks, & spots.All carpet shall be free of obvious spots & stains (not to exceed 3'X3') & shall be clean & free of dirt & debris.All dust, lint, liter & dry soil shall be removed from surfaces of desks, Chairs, file cabinets & other furniture & windowsills to a line 70" above the floor level.Damp wipe all heating & air conditioning grills & diffusers using cleaning solution so they are free of grime, smudges & stains & shall have a clean, bright appearance.Do not dust computers, typewriters, & other business machines.Drinking fountains will be cleaned to be free of water marks & any other debris or encrustation & shall be maintained at a high level of sanitation.Ornamental metal surfaces (including brass & aluminum) in entrances, corridors & lobbies (interior & exterior) shall have a polished & lustrous appearance.All trash (including trash in restrooms) will be collected & removed to a location designated by the COTR.Trashcans shall be emptied & kept clean & free of dirt, stains & debris.All trashcans shall have plastic liners.Rest rooms will be cleaned & sanitized with a disinfectant cleaner & shall be free of dust, dirt, debris, or bacteria.Fixtures will be free of dust, streaks & encrustation.Partitions, doors, windows, vents, sills, & walls will be free of obvious dirt, graffiti, & dust.Clean & descale toilet bowls & urinals, so that the entire surface will be free from streaks, stains, scale, scum, urine deposits, & rust stains. Restrooms/locker rooms/holding cells shall be resupplied with toilet paper, paper towels, & hand soap so that supplies do not run out.NOTE: Detainees Holding cells will only be entered for the purpose of cleaning or re-supplying when prisoners are not present.Floor drains shall be scrubbed clean of scum, hair & mop strings.Drains will have a bright & clean finish.Ceramic tile grout shall be scrubbed clean of dirt, stains, mold & encrustation.Ceramic wall tile grout shall be scrubbed clean of dirt, stains, mold & encrustation.All entranceways, steps, landings, patios, sidewalks, parking areas, driveways, loading docks, courtyards & platforms shall be free of obvious dirt, debris & weeds.The KTR shall remove oil stains to every extent possible. Entrance rugs shall be free of obvious spots & stains, & shall be clean & free of dirt & debris.Govt floor mats shall be laid out during inclement weather in entranceways & lobbies.The mats shall be cleaned, removed & stored when no longer required.LAWN & GROUNDS MAINTENANCE & QUALITY REQUIREMENTS: All required landscape maintenance will be performed during the growing season on a cycle to maintain the outside area in a neat & clean-cut manner.Service included in landscape maintenance are watering, mowing, trimming, edging, raking, weed control, & policing to keep the area clean & free of debris. Policing the Grounds, & removing any sand that has shifted & formed piles.KTR shall be held liable for any damage to grounds, vegetation, or l&scaping, due to his/her own negligence. The KTR shall arrange for satisfactory supervision of the contract.The KTR or its Supervisor/Managers shall act for the KTR.Supervision shall be available at all times. The Govt will not supervise the KTR's employees, directly or indirectly.On-site Supervisor/Manager.The KTR shall provide in writing the names, telephone numbers & pager numbers of the Site Supervisor/Manager & Alternate with their quotation, that will be the point of contact for the Contracting Officer & the COTRs for communication, & technical direction.The Manager &/or alternate shall have full authority to act for the KTR on all contract matters relating to the daily operations of this contract.The contract manager &/or alternate shall be able to read, write, speak, & understand English to the satisfaction of the COTR. The manager or alternate must respond verbally within 30 minutes after being phoned or paged.The manager &/or alternate shall be responsible for submitting the KTR employees daily work schedules to the COTR throughout the performance of the contract. The manager or alternate shall be available during normal duty hours (between 8:00 a.m. & 4:30 p.m. 5 days a week to discuss problem areas. The KTR will assign a Team Leader for locations with two or more employees.Unlike the contract manager & alternate, the team leaders do not have the authority to act for the KTR in all matters relating to the daily operations of the contract.The team leader is that person on a janitorial team at each location who is delegated to report all customer complaints to the Manager &/or alternate, thereby acknowledging receipt of the complaint.The identity of the team leaders must be identified in writing to the COTRs for each location.The team leaders shall act under the supervision of the Manager &/or alternate on all contracts matter relating to the daily operations of this contract. Qualifications of Manager & alternate engaged in directing the work to be accomplished under this contract shall possess at least 2 years of recent experience (within the past 5 years), in directing cleaning-type operations in a manager capacity for buildings of the approximate size of the building(s) to be cleaned under this contract.Competent management personnel shall be employed, & they will, at a minimum, have also completed a supervisory training course. At the discretion of the Contracting Officer experience may be substituted for formal training.A detailed resume of the Manager & alternate must be submitted with the quotation & if the Manager or alternate is being replaced a resume must be submitted along with a notification & the replacement name to the contracting officer. Both new & replacement employees must meet the following qualification standards: Qualifications of a Team Leader must be able to read, write, speak, & understand English to the satisfaction of the COTR, the PAIC or the ranking manager for the service locations.This employee shall be trained by the KTR & qualified in custodial type work.Qualifications of Other KTR Personnel employed by the KTR shall be capable employees, trained & qualified in custodial type work. Personnel Training: All contract employees are required to attend an orientation conducted by the COTR (or his or her designee).The orientation will include an explanation of the occupant agency's function & may include a tour of the building/facility.It will also familiarize contract employees with key client agency personnel & areas of the building/facility requiring special attention. The KTR is required to provide necessary & on-going tenant relations training for their employees.This training will stress the importance of conflict avoidance & problem resolution.Emphasis will be placed on grooming, proper attire & the importance of professionalism & courtesy in day-to-day contacts with building occupants & visitors. ITEMS FURNISHED BY THE GOVT: Electrical power at existing outlets for the KTR to operate such equipment as is necessary in the conduct of his work.Hot & cold water as necessary, limited to the normal water supply provided in the building.No special heating or cooling of the water will be provided.Storage Space: At some locations, space in the building for the storage of supplies & equipment to be used in the performance of work under the contract.The KTR shall maintain this space in a neat & orderly condition.No flammable or explosive liquids such as gasoline will be stored in the building.The Govt will not be responsible for damage or loss to the KTR's stored supplies or equipment.Janitor's closets, where available, will be provided for storing supplies & equipment.Prior to commencing work on the project, the Govt shall furnish a security badge to the KTR & the KTR's employees, which must be worn at all times while on the Govt installation.PERMITS & LICENSES: In the performance of work hereunder, the KTR shall obtain & maintain in effect all necessary permits & licenses required by Federal, State, or local Govt, or of any other duly constituted public authority.Further, the KTR shall obey & abide by all applicable laws & ordinances.Failure of the KTR to comply with this requirement will not relieve him of his responsibilities to perform under this contract.KTR'S EMPLOYEES: The KTR & his employees & any subKTR shall become familiar with & obey all station regulations, including fire, traffic, & security regulations.All personnel shall keep within the limits of the work area & shall not enter any restricted areas unless required to do so & are cleared for such entry. The KTR shall be responsible to the Govt for acts & omissions of his own employees & of subKTRs & their employees.The INS has taken aliens from various nationalities into physical custody at some facilities pending the conclusion of Immigration hearings, release on bonds, recognizance, or supervision.The KTR's employees must realize that the detainees are detained against their will & would seize any opportunity to escape.The KTR's employees should avoid contact with them whenever possible.KTR's employees shall not engage in conversation with detainees for any reason.The KTR must agree that each person employed by his firm or any SubKTR(s) shall have a Social Security Card issued, by the U.S. Social Security Administration, (a) be a United States citizen or (b) a person lawfully admitted into the United States, eligible for employment.Subject to existing laws, regulations, & other provisions of this Contract, illegal or undocumented aliens shall not be employed by the KTR to work on, under or with this Contract.The KTR will ensure that this provision is expressly incorporated into any & all subcontracts or subordinate agreements issued in support of this Contract.NOTE: The Govt restricts the employment under the contract of any KTR Employee, or prospective Contract Employee who is identified as a potential threat to the Health, Safety, Security, or general well being of any Govt Installation."Right of First Refusal": The DOL has advised that Executive Order 12933, Non-displacement of Qualified Workers Under Certain Contracts (59 FR 53560 & 60 FR 36756), is applicable for this labor category, in accordance with the Executive Order. PHYSICAL SECURITY: The KTR shall be responsible for safeguarding all Govt property provided for KTR use.At the close of each work period, Govt facilities, equipment, & materials shall be secured.Key Control. The KTR shall establish & implement methods of ensuring that all keys issued the KTR by the Govt are not lost or misplaced & are not used by unauthorized persons.No keys issued the KTR by the Govt shall be duplicated.The KTR shall develop procedures covering key control that will be included in the quality control plan.The KTR shall report the loss or duplication of keys to the COTRs.It is the responsibility of the KTR to prohibit the use of keys issued by the Govt by any persons other than the KTR's employees.It is also the responsibility of the KTR to prohibit the opening of locked areas by the KTR's employees to permit entrance of persons other than KTR's employees engaged in the performance of assigned work in those area.CONSERVATION OF UTILITIES: The KTR shall instruct its employees in utilities conservation practices.The KTR shall be responsible for operating under conditions, which preclude the waste of utilities, which shall include: Lights shall be used only in areas where & when work is being performed.Mechanical equipment controls for heating, ventilation, & air conditioning systems shall not be adjusted by the workers.Water faucets or valves shall be turned off after the required usage has been accomplished.Any malfunctioning faucets, outlets, switches, etc. are to be identified to the COTRs.LOST & FOUND PROPERTY: It is the responsibility of the KTR to ensure that all items of personal or monetary value found by the KTR's employees are turned in to the COTR (for that site) the same day or no later then the next work day.TRANSPORTATION: The KTR shall, at his own expense, make all the arrangements necessary for the transportation of all tools, equipment, materials & employees necessary to carry out the work under the contract. PAYMENT: General: Payment will be made on a calendar month basis in arrears, upon submission of an invoice. Payment will be due within 30 calendar days (except for the final monthly payment) after receipt of a proper invoice or date of receipt of services, whichever is later. INSPECTION & ACCEPTANCE: The Contracting Officer will designate COTR & an Alternate COTR at time of award.The responsibilities of the COTR include, but are not limited to: determining the adequacy of performance by the KTR in accordance with the terms & conditions of this contract; compliance with contract requirements insofar as the work is concerned; & advising the Contracting Officer of any factors which may cause delay in performance of the work.Contract Cleaning Inspectors: Contract inspectors are subordinates of the COTR & are responsible for the inspection & monitoring of the KTR's work.The responsibilities of the inspector include, but are not limited to: inspecting the work to ensure compliance with the contract requirements; documenting through written inspection reports the corrected; conferring with representative of the KTR regarding any problems encountered in the performance of the work & generally assisting the COTR in carrying out his/her responsibilities. In addition to the above, a COTR will make a periodic walk through of the building & other areas covered by this contract with the KTR's representative when possible, to ascertain the level of services being performed.The KTR will be notified of any deficiencies noted. EXTRA WORK: No charge for additional services or materials will be allowed unless authorized by the Contracting Officer in writing. Govt Liability: The Govt shall not be liable for any injury to the KTR's personnel or damage to the KTR's property unless such injury or damage is due to negligence on the part of the Govt & is recoverable under the Federal Torts Claims Act, or pursuant to other Federal statutory authority.KTR'S INSURANCE REQUIREMENTS: The KTR shall maintain insurance in an amount not less than $100,000.00 to protect him from claims under workman's compensation, general liability, & from any other claims for damages for personal injury, including death which may arise from operations under this contract whether such operations by himself or by any sub-KTR or anyone directly or indirectly employed by either of them.Certificates of such insurance shall be subject to the approval of the Contracting Officer for adequacy of protection.Within 10 workdays prior of commencing work, the KTR shall submit on a form satisfactory to the Contracting Officer, evidence of all insurance coverage indicated above.In addition, the KTR shall furnish written evidence of a commitment by the insurance carrier(s) to notify the Contracting Officer in writing of any material change, expiration, or cancellation of any of the insurance policies not less than 30 days before such change, expiration or cancellation is effective.Such written notices by the insurance carrier(s) shall state "firm commitments" to furnish notifications, not just " pledges to endeavor" to furnish notifications of changes, expirations or cancellations.INS reserves the right & prerogative to require the KTR to remove any contract employee from the INS contract.Terminate the services & restrict access to the facility of any KTR employees who may be an offender, or whose personal habits, criminal history or inclinations are in conflict with DOJ st&ards of conduct, 28 CFR 45.731.1 through 45.731.26 or who otherwise may be a security risk.The KTR shall notify the Administrative Contracting Officer of all employee resignations, termination's, or transfers.The COTR shall have the right to inspect the procedures, methods, & facilities utilized by the KTR in complying with the security requirements under this contract. The KTR must agree that each person employed by his firm or any subKTR(s) shall have a social security card issued & approved by the Social Security Administration, & shall be a US Citizen, or a person lawfully admitted into the US, eligible for employment, & have no criminal record.Each employee of the KTR, & of any subKTR(s), must complete & sign a Form I-9, "Employment Eligibility Verification", before commencing work.The KTR shall retain the original Form I-9 & shall furnish the COTR a copy of the Form I-9 before the employee commences work.The KTR shall be responsible to INS for acts & omissions of his own employees & of any subKTR(s) & their employees.PAST PERFORMANCE: Provide the full name of the proposed manager or managers & alternate(s).Provide a detailed description of the previous 5 years employment history of the proposed manager.The name(s) & address(s) of the companies for whom the proposed managers & alternate's worked for the past 5 years, along with the name(s) & telephone number(s) of his or her immediate manager.Provide the name & phone number for your banking reference. The provisions at 5.212-1 applies to this acquisition. The NAICS code is 56172.12.212-2 is applicable.Paragraph (a), evaluation criteria is as follows: Award will be made to the most advantageous offer to the Govt, price & past performance factors considered.
