- The U.S. Department of Commerce/National Oceanic and Atmospheric Administration intends to award two sole source Purchase Orders in accordance with Simplified Acquisition Procedures with a period of performance of 12-months each under the authority of 41 U. S. C. 253 (c)(1) only one responsible source. The requirement is to provide for the continuation of previously contracted legal services in connection with proposed loan guarantee transactions under the Guaranteed Steel/Oil and Gas Loan Program. Curtis, Mallet-Prevost and Haynes and Boone previously provided theses services for the loan guarantee transactions that have closed to date. These are highly complex transactions involving reorganization efforts from bankruptcy, and hence resembles closely the anticipated transactions arising out of the loan applications that the Board has been told to expect by prospective applicants. It is very important to the Board that the experience level be maintained for the anticipated loan guarantee transactions expected to result from this second round of loan guarantee applications. Vendors who believe they can meet this requirement are required to submit in writing an affirmative response demonstrating a comprehensive understanding of the Emergency Steel Loan Guarantee and Emergency Oil and Gas Loan Program objectives. All written responses must include a written narrative statement of capability, including detailed technical information demonstrating their ability to meet the above requirements. The response must be sufficient to permit agency analysis to establish a bonafide capability to meet the requirements. Failure to submit such documentation will result in the Government proceeding as stated above. A determination by the Government not to open the requirement to competition based upon responses to this notice is solely within the discretion of the Government. Affirmative written responses must be received no later than 15- days after publication of this synopsis.
