Description

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued. The solicitation number is EP1751-01 and this solicitation is issued as a Request For Proposals (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 97-23. The North American Industry Classification System code is 335931 and small business size standard is 500. UNICOR, Federal Prison Industries, Inc., intends to enter into a five-year, firm-fixed-price, indefinite delivery/indefinite quantity supply contract for the following commercial items: Item 00001 Cable, M, 85045/18-01N, F/O, 4-Fiber-Multi-Mode, Rev B, UNICOR part number CBL5936, guaranteed minimum quantity: 17,000 ft, estimated maximum quantity: 166,000 ft; Item 00002 Optical Cable, C, Optical Cable Corporation number BX36-185K-W3EB/1UC/900-OFNP or equivalent, may be supplied in standard mill lengths (Optical Cable Corporation, 5290 Concourse DR, NW, Roanoke, VA 24019-3059, telephone (540) 265-0690), 36 fiber, 62.5/125 um, indoor/outdoor plenum rated, breakout style, FDDI, gray jacket, multimode, OFNP, UNICOR part number CBL8377, guaranteed minimum quantity: 13,000 ft, estimated maximum quantity: 166,000 ft; Item 00003 Cable, D, SM-D-436132 rev M, Cord, Sub-Assy, Electrical, UNICOR part number CBL6973, guaranteed minimum quantity: 3,000 ea, estimated maximum quantity: 25,000 ea; Item 00004 Cable, C, WM59A/U, SBR-Jacket, Type-JS-L, UNICOR part number CBL0157, guaranteed minimum quantity: 40,000 ft, estimated maximum quantity: 166,000 ft. Further description of each line item is provided on the pricing sheet. The government has the option to add future line items within the same scope of items if price is determined to be fair and reasonable. Required delivery of each line item shall be: 126 days (for CBL5936), 84 days (for CBL8377), 80 days (for CBL6973), and 120 days (for CBL0157) from receipt of each delivery order issued. The following FAR clauses and provisions apply to this acquisition: 52.247-34 Destination, delivery shall be FOB destination with a ship to address of UNICOR, FPI Memphis, 1101 John A. Denie Road, Memphis, TN 38134. The COTR is Kevin Rogers, telephone (901) 372-6450; 52.212-1, Instructions to Offerors -- Commercial; 52.212-2, Evaluation -- Commercial Items, evaluation of offers will be based on 40% price and price related factors and 60% past performance including on-time delivery; 52.212-3, Offeror Representations and Certifications -- Commercial Items -- must be completed and provided with offer; 52.212-4, Contract Terms and Conditions -- Commercial Items; 52.212-5, Contract Terms and Conditions Required to Implement Statues or Executive Orders -- Commercial Items, which includes 52.203-6, Restrictions on Subcontractor Sales to the Government, with Alternate I and 52.232-33, Payment of Electronic Funds Transfer -- Central Contractor Registration; 52.204-6, Contractor Identification Number Data Universal Numbering System (DUNS); 52.216-18 Ordering, orders may be issued under the resulting contract from the date of award through five (5) years thereafter; 52.216-19, Order Limitation applies with (a) minimum order of 1,000 ft (for CBL5936), 1,000 ft (for CBL8377), 10 ea (for CBL6973), and 1,000 ft (for CBL0157); (b)(1) max order for a single item in excess of 100,000 ft (for CBL5936), 15,000 ft (for CBL8377), 3,000 ea (for CBL6973), and 10,000 ft (for CBL0157); (b)(2) any order for a combination in excess of 128,000 each; each contractor will not be obligated to honor. Contractor will not be obligated to honor a series of orders from the same ordering office, within a 15 day period that together call for quantities exceeding the maximum order limitations. However, the contractor shall honor orders exceeding the maximum order limitations unless the order, or orders, is returned to the ordering office within seven calendar days after issuance with a written statement expressing the contractor's intent not to ship; 52.216-22 Indefinite Quantity -- applies until 126 days after contract validity end date; 52.211-6 Brand Name or Equal; 52.211-16 Variation in Quantity -- with 5 percent increase or 0 percent decrease (for CBL5936), with 0 percent increase or 0 percent decrease (for CBL8377), with 2 percent increase or 0 percent decrease (for CBL6973), and with 5 percent increase or 0 percent decrease (for CBL0157); 52.232-18 Availability of Funds; and 52-211-14 Notice of Priority Rating for National Defense Use and 52-211-15 Defense Priority and Allocation Requirements item 0004 of this order is rated DOC9. Local clause FPI 1000H1 Economic Price Adjustment applies: Twelve months after contract award date, contract prices for the succeeding twelve-month period may be adjusted in accordance with the change in the Producer Price Index/product code (for item 00001, item 00003, and item 00004: PCU3357#1, Nonferrous wiredrawing and insulating, Electronic wire and cable; for item 0002: PCU3357#E, Nonferrous wiredrawing and insulating, Fiber optic cable) from the date of award to the date of adjustment. IT IS THE CONTRACTOR'S RESPONSIBILITY TO REQUEST THIS ADJUSTMENT. Adjustments may be requested for a period not to exceed 30 days after the eligible adjustment date. Requests that are made after the 30-day limit will not be honored and the contract pricing will not be adjusted. The contractor shall submit any requests for adjustments in writing to the contracting officer. Requests shall include a copy of the relevant index and must be within the allowed time period for adjustment. Any adjustments authorized as a result of the adjustment request will not be retroactive. The date the completed request is received by the contracting officer will be the effective date of any changes in price. The contractor also is required to request downward price adjustments. All downward adjustments will be retroactive to the authorized adjustment date as specified in this clause. If downward price adjustments are not requested and this is later revealed through audits or otherwise, the contractor shall reimburse the Government the amount overcharged plus interest. Interest will be computed at the rate set annually by the Secretary of the Treasury for late contract payments. Interest will accrue from the date the adjustment should have been made. In computing any contract price adjustment, the most recently published index as of the date of award will be compared to the most recently published index as of the date of adjustment. No adjustment shall be made if the referenced change is less than 2%. Total upward adjustment for the contract period, including any option periods, shall not exceed 10%, based on the original or option period contract price; downward adjustments are not limited. In addition, FPI9999.999-9, Business Management Questionnaire must be completed with a minimum of three references of contracts that are of similar size and complexity. OMB Clearance 9000-0136 expires 9/30/01. Offer must indicate Solicitation No. EP1751-01, time specified for receipt of offer, name, address and telephone number of offeror, technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation, terms of any expressed warranty, price and any discount terms, remit to address, a completed copy of representations and certifications at FAR 52.212-3, and acknowledgement of all amendments, if any. All offers that fail to furnish required representations and certifications or information or reject the terms and conditions of the solicitation may be excluded from consideration. The Government may make award without discussions; therefore, the offeror's initial offer should contain offeror's best pricing. Award(s) will be made based on best value to the government. Any amendments hereby issued to this solicitation shall be synopsized in the same manner as this solicitation and must be acknowledged by each offeror. Offeror must hold prices firm for 60 calendar days from the date specified for receipt of offers. Offers or modifications to offers received at the address specified for the receipt of offers after the exact time specified may not be considered.
