- Construction Manager as Constructor (CMc) Services Contract are required for the alteration and renovation of the Potter Stewart U.S. Courthouse in Cincinnati, Ohio. The scope of the CMc services under this proposed contract includes Pre-construction Phase Services and an option for Construction Phase Services. A firm-fixed price contract is contemplated. The government will evaluate price proposals, which are to be evaluated in Stage II, according to the CMc's cost of Pre-construction Phase Services as the base contract and Construction Phase Services as an option. The government contemplates that the option pricing will be broken down, for evaluation purposes, into prices corresponding to: Construction Phase Construction Management Services, the general construction, profit, overhead, daily delay rate, subcontractor commission, and general conditions. A firm-fixed price based upon the general construction services required will be negotiated prior to exercising the Construction Phase Option. The CMc will be competitively chosen using Source Selection Procedures (FAR 15.3). For this procurement, technical factors when combined are significantly more important than cost or price. Project Summary: This project proposes a modernization and courts reorganization project at the Potter Stewart U.S. Courthouse in Cincinnati, Ohio. The Courthouse was constructed in 1939 as the U.S. Post Office and Courthouse and was recently renamed in honor of the former U.S. Supreme Court Justice. The 10-story building contains 499,841 gross square feet of space and is eligible for inclusion on the National Register of Historic Places. The building currently houses approximately 321 employees primarily from the U.S. Circuit and District Courts of the Southern District of Ohio (Sixth Circuit). The primary purpose of this prospectus project is to meet the expansion and realignment needs of the Circuit and District Courts. This project will alleviate many of the deficiencies in the fire/life safety, electrical, and heating/ventilation air conditioning systems of the Courthouse. Elements of work that are envisioned to be included as part of the renovation include: Replacement of main electrical equipment, installation of new electrical distribution system for the building, relocation of main computer room and associated structured cabling, replacement of all major air handling equipment, replacement of existing radiators and other electrical improvements, approximately 85,000 SF of demolition and tenant improvement work, and the construction of new Special Proceedings Courtroom and associated support space. The building will be occupied during construction and all construction work will be performed after normal building hours. FUNDS ARE NOT CURRENTLY AVAILABLE. This CMc contract is envisioned to be procured through a source selection process that will incorporate a base contract and options for those elements of work that can be executed within the congressionally mandated cost limitation. As part of the CMc Pre-construction Phase, the CMc shall work with the A-E and the Government in a cooperative team effort to ensure a quality project, within the mandated schedule and budget. The CMc's scope of services under the pre-construction portion of this contract may include, but is not limited to: Performing constructability reviews, reviewing cost estimates, preparing independent cost estimates, developing a construction phasing plan, controlling schedules, keeping records, reporting on progress, resolving problems, coordinating with the tenants, proposing and coordinating tenant movement during construction (swing space), conducting value engineering (VE) exercises, performing administrative services, and developing subcontractor and supplier interest, in addition to other related services deemed necessary to provide for a completely functional facility. The estimated construction cost of this project is in the range of $15,000,000.00 to $20,000,000.00 with an anticipated construction duration of approximately 2.5 years. This amount does not include Pre-construction Phase services (the base contract). The option for Construction Phase Services shall include, but is not limited to, the renovation of the existing building and it's systems, administration of the construction contract and all subcontracts, coordination of regular construction meetings, CPM scheduling, and monitoring of construction costs. Definition of Construction Manager as Constructor. A Construction Manager as Constructor, or CMc, is defined as a firm engaged under direct contract to a building owner, in this case the General Services Administration (GSA), to provide services such as constructability reviews, independent cost estimating, scheduling and general construction services. The CMc shall be an active and responsible member of the project development team during the preconstruction and construction phases along with GSA as the owner/developer and GSA's selected A-E firm. Continuity of key personnel for the duration of the project will be essential and mandatory. At the time of contract award, which is projected to coincide with the completion of the construction documents for this project, or shortly thereafter, the CMc's firm price for Pre-construction Phase Services will form the base contract and Construction Phase Services will form an option that will be negotiated upon the award of the option. Project development shall occur in general conformance with the process described in the American Institute of Architects Document A121/CMc (also known as AGS Document 565) and Standard Form of Agreement Between Owner and Construction Manager Where The Construction Manager Is Also The Constructor. The services requested of the CMc shall cover a wide range of design and construction activities, which are often performed by both Construction Managers (CMs) and General Contractors (GCs). In contrast to a CM that is not also a constructor, the CMc is at risk and is responsible for involvement in the project development and administration of the construction. The CMc is also responsible for construction activities as designed for the facility as described by the Government at or below the defined budget or Estimated Construction Cost (ECC). Proposal Submission Requirements. Proposals will be evaluated using a two stage, source selection process. Under Stage I, offerors must submit information regarding qualifications, past experience, past performance, personnel, and resources. Submissions shall clearly address the evaluation factors identified in the Stage I RFP. The evaluation factors stated in the RFP represent the factors that will be used in Stage I by the Source Selection Board in evaluation and determination of a competitive range of firms. A competitive range of the most highly qualified firms will then be invited to submit proposals for Stage II. Firms determined to be in the competitive range shall participate in an oral presentation that will take place in Cincinnati, Ohio. Final selection will be made based on source selection procedures with the collective factors listed in the Stage II RFP. These technical factors are considered substantially greater in weight than cost or price. The Government reserves the right to make an award based on Stage II proposals without holding discussions. Contract Award. The base contract will be awarded to the selected firm to provide Pre-construction Phase services with an option to provide Construction Phase services. SB -- SDB Participation. This is open to both large and small business concerns in accordance with the Small Business Competitiveness Demonstration Program. Although this procurement is open to large business firms, small, small woman-owned, small minority-owned, small HUBZone, and small Veteran-Owned (including service disabled Veteran-Owned firms) are strongly encouraged to participate. The Government recognizes the talent existing in smaller firms and encourages their participation in the construction and renovation of Federal facilities. In accordance with 15 USC 631 Et. Seq., the CMc, if a large business, will be required to provide the maximum practical opportunities to small, small woman-owned, HUBZone small, small business concerns owned and controlled by socially and economically disadvantaged individuals and Veteran-Owned small business concerns through participation as subcontractors in the performance of this contract. In Stage II of this process, each firm in the competitive range will be required to submit an acceptable subcontracting plan and individually determine the minimum acceptable subcontracting target goals for this project. An acceptable subcontracting plan must be reviewed and approved by SBA prior to award of this contract. Small businesses are not subject to this requirement. Firms seeking consideration for this contract shall demonstrate a proactive effort to achieve the highest subcontracting goals for the above mentioned concerns by also providing a brief written narrative (limited to one type written page) of outreach efforts made to utilize these groups. A small business criterion for each category is based on the contractor's average annual receipts for the proceeding three fiscal years. Contact your local SBA office for further information. In order to receive the benefit of a price evaluation preference, you must be certified by the Small Business Administration as a HUBZone small business concern and/or a small disadvantaged business concern. Joint Ventures. Joint venture or firm/consultant arrangements will be considered and evaluated on a demonstrated interdependency of the members to provide a quality CMc team effort. How to Offer. Potential offerors having the capabilities to perform the services described herein are invited to respond by submitting a one-page letter on company letterhead stating interest in the project. These firms will be provided a copy of the Stage I Request for Proposals (RFP) package. The RFP will provide additional information regarding the submission format.
