Description
The U.S. Army Space and Missile Defense Command (SMDC) intends to enter into a non-competitive follow-on contract modification with Trex Enterprises Corporation for completion of research and development of a unique multi-spectral imager technology. The proposed effort will allow Trex to bring to logical conclusion the development of a very high resolution, low power camera that will image in the visible, ultraviolet (UV), infrared (IR), and X-Ray spectra. In order to image in these various spectra, customized photoconductive coatings must be produced that are optimized to the desired wavelengths. The original effort allowed for development of the independent sensors but did not provide sufficient effort to fabricate the high-resolution cameras and to optimize the performance in all of the spectra. In addition to completing the development of this highly specialized camera, the additional effort will develop a stitching technique to allow for the fabrication of very large-scale readout electronics. This technique is only possible because of the proprietary methodology that TREX has employed to create these image sensors. Competition is not contemplated. The proposed effort allows the existing effort to be brought to its logical conclusion. The uniqueness of the image sensor cannot be duplicated by another contractor and the expense to the government to develop another source will both be substantial and not recoverable through the competition. TREX holds a broad patent on the readout electronic format technology, and no other source can duplicate this format without infringing this patent. TREX also has proprietary rights in additional, more detailed technical information concerning this technology which they developed at private expense and which is essential for the successful completion of this proposed follow-on effort. Such detailed proprietary information is not available to other sources, and it makes TREX the only source which is capable of successfully completing the proposed follow-on effort. Authority: 10 U.S.C. 2304(c)(1) and Federal Acquisition Regulation (FAR) 6.302-1 (a) (2) -- only one responsible source and no other supplies or services will satisfy agency requirements; (a)(2)(iii) -- follow-on contract for continued highly specialized services where award to any other source will result in substantial cost duplications that are not expected to be recovered through competition; and (b)(2) -- existence of limited rights, patent rights and secret processes. This acquisition is not open to allied participation at the prime or subcontractor level. Collect calls will not be received. See Note 22.
