- Description
- (i) THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6, AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; A PROPOSAL IS BEING REQUESTED AND A WRITTEN SOLICITATION WILL NOT BE ISSUED. (ii) SOLICITATION NO. BBGCON3601S5246-BJS IS ISSUED AS A REQUEST FOR PROPOSAL (RFP) AND A CONTRACT WILL BE AWARDED USING THE CONTRACTING BY NEGOTIATION PROCEDURES. (iii) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 97-27 dated June 25, 2001. (iv) This is a sole-source procurement for ADP Support Equipment under NAICS 511210. (v) The Broadcasting Board of Governors (BBG), International Broadcasting Bureau (IBB), Office of Engineering and Technical Services, Engineering Technical Directorate, intends to non-competitively negotiate a firm-fixed price (FFP) contract award, contingent upon availability of funding, to Lockheed Martin Global Telecommunications for the license and maintenance of COMPLAN and STAR software. The basis for using "Other Than Full and Open Competition" for this procurement is 41 USC 253 (c)(1) and FAR Subpart 5.302-1 (Only One Responsible Source and No Other Supplies or Services will satisfy Agency requirements). Lockheed Martin Global Telecommunications is the only company that can provide the COMPLAN and STAR software license and maintenance due to the existence of limited rights or patent rights. (vi) Statement of Work. The Contractor shall provide the Microsoft Windows version of Lockheed Martin Global Telecommunications COMPLAN software on CD-ROM or diskette, including installation, testing, and manuals; two perpetual floating licenses (tokens) for use with existing HP-UNIX server; telephone support and program maintenance. The Contractor shall provide the Microsoft Windows version of Lockheed Martin Global Telecommunications STAR Suite, which includes Link Analysis, Propagation Analysis, and Antenna Coverage Programs. The Contractor shall provide the software on CD-ROM or diskette, including installation, testing and manuals; two perpetual floating licenses (tokens) for use with existing HP-UNIX server; telephone support and program maintenance. The Contractor shall provide a two-day training class for up to five (5) people. Class material will cover both COMPLAN and STAR. The Contractor and the BBG shall mutually agree upon the training dates and location. The Contractor shall provide all necessary professional, technical and other staff as may be needed for contract performance. The Contractor shall be responsible for providing the following requirements: BASE YEAR, CONTRACT LINE ITEM (CLIN) 1: First License COMPLAN-DB, Communications Planning Tool (for frequency and transmission planning). Windows NT Operating System. Single, perpetual floating license (token) to include 25 hours of telephone support and one year of program maintenance, QUANTITY: 1 EACH; CLIN 2: Additional COMPLAN-DB License. Windows NT Operating System. Single, perpetual floating license (token) to include 25 hours of telephone support and one year of program maintenance, QUANTITY: 1 EACH; CLIN 3: First License COMSAT STAR Suite with Link, PAP, and ACP. Windows NT Operating System. Single, perpetual floating license (token) to include telephone support and one year of program maintenance, QUANTITY: 1 EACH; CLIN 4: Additional License, COMSAT STAR Suite with Link, PAP, and ACP. Windows NT Operating System. Single, perpetual floating license (token) to include telephone support and one year of program maintenance, QUANTITY: 1 EACH; CLIN 5: Configuration PC with COMPLAN, STAR, License Manager, other software as needed. Installing the PCs at BBG/IBB. Converting all COMPLAN user files from the UNIX system onto the PC. Verifying the system is correctly configured with COMPLAN, and that all files are correctly converted, QUANTITY: 1 EACH; OPTION YEAR ONE, CLIN 6: COMPLAN Maintenance to include 25 hours of telephone support, program maintenance, and program updates, QUANTITY: 1 YEAR; CLIN 7: STAR Maintenance to include 25 hours of telephone support, program maintenance, and program updates, QUANTITY: 1 YEAR; OPTION YEAR TWO, CLIN 8: COMPLAN Maintenance to include 25 hours of telephone support, program maintenance, and program updates, QUANTITY: 1 YEAR; CLIN 9: STAR Maintenance to include 25 hours of telephone support, program maintenance, and program updates, QUANTITY: 1 YEAR; OPTION YEAR THREE, CLIN 10: COMPLAN Maintenance to include 25 hours of telephone support, program maintenance, and program updates, QUANTITY: 1 YEAR; CLIN 11: STAR Maintenance to include 25 hours of telephone support, program maintenance, and program updates, QUANTITY: 1 YEAR; OPTION YEAR FOUR, CLIN 12: COMPLAN Maintenance to include 25 hours of telephone support, program maintenance, and program updates, QUANTITY: 1 YEAR; CLIN 13: STAR Maintenance to include 25 hours of telephone support, program maintenance, and program updates, QUANTITY: 1 YEAR. (vii) The term of the contract will be for a one-year period from date of contract award with options to extend for four additional one-year periods, which may be exercised at the Government's discretion subject to availability of funding. (viii) The provision at FAR 52.212-1, Instruction to Offerors -- Commercial Items is hereby incorporated by reference. Offerors responding to this solicitation shall submit prices for each of the above-listed contract line items (CLINS). (ix) The Government will award a firm-fixed price (FFP) contract resulting from this RFP. (x) Offerors shall include a completed copy of the provisions at FAR 52.212-3, Offeror Representations and Certifications -- Commercial Items. Proposals must also include prompt payment terms and correct remittance address if different from mailing address. (xi) The clause at 52.212-4, Contract Terms and Conditions -- Commercial Items applies to this acquisition-with no addenda to the clause. (xii) FAR Clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders -- Commercial Items, including subparagraphs (b) (6, 7, 8, and 9) applies to this acquisition as well as the following clauses contained with FAR Clause 52.212-5: 52.222-21, Prohibition of Segregated Facilities; 52.222-26, Equal Opportunity (E.O. 11246); 52.222-35, Affirmative Action for Disabled Veterans and Veterans of the Vietnam Era (38 U.S.C. 4212); 52.222-36, Affirmative Action for Workers with Disabilities (29 U.S.C. 793); 52.222-37, Employment Reports on Disable Veterans and Veterans of the Vietnam Era (38 U.S.C. 4212); 52.225-3, Buy American Act -- Supplies (41 U.S.C. 10); 52.232-33, Payment by Electronic Funds Transfer -- Central Contractor Registration (31 U.S.C. 3332). (xiii) FAR 52.232-18, Availability of Funds applies to this procurement. (xiv) The Defense Priorities and Allocations System (DPAS) and assigned rating is not applicable to this acquisition. (xv) There are no CBD numbered notes which apply to this procurement. (xvi) Failure to provide any of the above required items may result in the rejection of your proposal.
