Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.!! 17(ii). This solicitation document and incorporated provisions and clauses are those in effect at time of solicitation!! 17(iii). This is a full and open procurement under SIC 5411, Professional Support Services.!! 17(iv). There are five contract line items, four of which are optional: CLIN 0001, Provides review, analysis and support to Office of Counsel, ONR relating to non-legal aspects of DoN Intellectual Property Program at ONR; CLIN 0002, Option Year One; CLIN 0003, Option Year Two; CLIN 0004, Option Year Three; CLIN 0005, Option Year Four.!! 17(v). Description: (1) Contractor personnel shall provide review, analysis and support to Office of Counsel, ONR relating to non-legal aspects of DoN Intellectual Property Program at ONR as required (estimated 2000 hours annually), 01- Nov 2001 31 Oct 2002 (2) General Requirements: As a minimum contractor shall perform contract evaluation and classification, establish and maintain records and files, establish relationships with Scientific Officer and Contract Officer, initially contact the Research Contractor, monitor the progress of the research, check compliance actions, have final contact with the Scientific Officer, furnish final report to cognizant ONR Patent Attorney, provide training and orientation at ONR and assist other ONR patent attorneys in other IP-related duties, on an as-needed basis. (3) Specific Criteria: Resume(s) must be submitted to show the following qualifications. Have technical background to understand the invention and technical reports, determine the adequacy of a description of an invention, and interview the technical personnel of the Performer and ONR. A minimum of 60 semester hours of mathematics, chemistry, physics, engineering and similar courses are required and a bachelor's degree in physics, chemistry, computer science, engineering or a similar technology is preferred. Knowledge of patent law principles and concepts is required. Work experience that required an understanding and the application of patent principles and concepts, such as, conception, actual reduction to practice, inventorship, person of ordinary skill, patentability bars of public use, on-sale, and publication, novelty, and nonobviousness is required. Knowledge of intellectual property clauses of the Federal Acquisition Regulations (FAR) and Defense Federal Acquisition Regulations (DFARS) and the application of the principles and concepts in those clauses is required. Related work experience is required. Work experience in invention surveillance and follow-up of procured research and development is required.!! 17(vi). Date of delivery is October 31, 2002; Place of Delivery and Acceptance is at ONR, 800 North Quincy Street, Arlington, VA; FOB: destination.!! 17(vii). Solicitation provision at FAR 52.212-1, Instructions to Offerors Commercial Items (OCT 1995) is hereby incorporated by reference.!! 17(viii). Award of the contract resulting from this solicitation will be made to the responsible offeror whose offer conforms with all the requirements of the solicitation, and whose proposal reflects the lowest cost or price. The Government reserves the right to eliminate from further consideration those proposals, which are considered non-responsive. An offeror must quote on all items in this solicitation to be eligible for award. The Government intends to make a single award to the acceptable offeror whose total offer on all items is the most advantageous to the Government, on the basis of best value to the Government.!! 17(ix). Offerors are reminded to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications Commercial Items, as well as 252.212-7000, Offeror Representations and Certifications Commercial Items, and 252.225-7035, Buy American Act North American Free Trade Agreement Implementation Act Balance of Payments Program Certificate with their offers.!! 17(x). Clause 52-212-4, Contract Terms and Conditions Commercial Items (OCT 1995), is hereby incorporated by reference.!! 17(xi). Clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes Or Executive Orders Commercial Items, is hereby incorporated by reference. The following paragraphs apply to this solicitation and any resultant contract (b)(2) 52.203-10, (b)(3) 52.211-16, (b)(4) 52.219-8, (b)(5) 52.222-26, (b)(6) 52.222-35, (b)(7) 52.222-36, and (b)(8) 52.222-37.!! 17(xii). Clause 252.212-7001, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items, is hereby incorporated by reference, with additional DFAR clauses included in this solicitation and any resulting contract, as follows: 252.225-7036.!! 17(xiii). Additional Contract Terms and Conditions applicable to this procurement are: (i) Variation in Quantity Clause. (ii) Type of Contract: A firm fixed-price contract will be awarded. (iii) Period of Performance: November 01, 2001 through October 31, 2002.!! 17(xiv). The Defense Priorities and Allocations Systems (DPAS) assigned rating for this procurement is unrated.!! 17(xv).
