Funds are not currently available for this procurement. The Government?s obligation hereunder is contingent upon the availability of appropriated funds from which payment for the contract purposes can be made. No legal liability on the part of the Government for payment of any money shall arise unless and until funds are made available to the Contracting Officer for this procurement and notice of such availability to be confirmed in writing by the Contracting Officer is given to the Contractor.=20 The Regional Contracting Department, Pearl Harbor , Hawaii intends to award a contract utilizing FAR part 13.5. Solicitation N00604-02-T-A143. This is a combined synopsis/solicitation for the acquisition of commercial supplies and services prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this announcement. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; PROPOSALS ARE BEING REQUIRED AND A WRITTEN SOLICITATION will not be issued. All prospective quoters are responsible for monitoring this site for the release of amendments (if any) or other information pertaining to this solicitation. All responsible sources may submit a quotation in response to this synopsis, which shall be considered. This synopsis/solicitation is being issued as a Request For Quotations (RFQ), for a Firm Fixed Price type contract incorporating provisions and clauses in effect through Federal Acquisitions Circular 2001-01 and DFARS Change Notice 20011101. This requirement is a 100% Small Business (SB) Set-Aside. The Regional Contracting Department, Pearl Harbor, Hawaii intends to award a contract for the following: ITEM 0001, Stelth Netting (Polyethylene twine or similar with ? inch to 1 1/8 inch mesh), to include installation to support beams of Building 473, Fleet and Industrial Supply Center (FISC), Pearl Harbor, Hawaii. The purpose of the netting is to deter large and small birds from entry. The building covers 43,500 sq. ft. with two (2) 800 sq. ft. cage areas inside. Qty 1 Job, FOB Destination, Pearl Harbor, Hawaii. The FSC code is S299. The NAICS code and the small business size standard for this procurement is 561710 and $5M respectively. A site visit for all prospective offerors will be held at FISCPH, Bldg. 473 on 29 November 2001. The maximum number of offeror representatives is two (2). All prospective offerors shall meet at the front entrance of FISCPH Bldg 475 at 9:00 a.m. (HST). All prospective offerors are highly encouraged to attend this site visit. Names of attendees is to be provided NLT two (2) days prior to the site visit to Richard J. Harr, Code 203A.RH, fax 473-5750 or email richard_j_harr@pearl.fisc.navy.mil. Failure to attend will be construed to mean that the offeror fully understands all requirements of the solicitation. Prospective offerors are advised that the site visit is for the purpose of explaining the requirement and visiting the area where all work is to be performed. Offerors are reminded that unless the requirement is amended in writing, the requirement will remain unchanged. In no event will failure to attend the site visit constitute grounds for a claim after award of the contract. All qualified responsible business sources may submit a quotation, which shall be considered by the agency. Contractor must be registered in the Central Contractor Registration Database (CCR) to be eligible for Department of Defense Contract awards. The following clauses are applicable: FAR 52.212-1, Instructions to Offerors?Commercial Items (addendum to paragraph (h): a single award will be made); FAR 52.212-2, Evaluation Commercial Items, the following factors shall be used to evaluate offfers: (1) Technically acceptable, (2) Price. REVIEW OF AGENCY PROTEST (FISCPH) (APR 2000) (a) The contracting activity, Fleet and Industrial Supply Center, Pearl Harbor (FISCPH), will process agency protest in accordance with the requirements set forth in FAR 33. 103 (d). (b) Pursuant to FAR 33. 103 (d) (4), agency protests may be filed directly with the appropriate Reviewing Authority or a protester may appeal a decision rendered by a Contracting Officer to the Reviewing Authority. (c) The Reviewing Authority for FISCPH is the Director, Regional Contracting Department (Code 200), Fleet and Industrial Supply Center, Pearl Harbor, at 1942 Gaffney Street, Suite 100, Pearl Harbor, HI 96860-4549. Agency procurement protests should clearly identify the initial adjudicating official, i.e., the Contracting Officer or Reviewing Official. (d) Quoters should note this review of the Contracting Officer?s decision will not extend GAO?s timeliness requirements. Therefore, any subsequent protest to GAO must be filed within 10 days of knowledge of initial adverse agency action. All prospective quoters interested in submitting a proposal for this solicitation shall include your name, address, telephone number and point of contact, fax number, e-mail address and commercial and Government Entity (CAGE) code.
