Description
Change to the synopsis/solicitation and Blanket Purchase Agreement clauses: The synopsis/solicitation is changed as follows: The Navy has determined that the Service Contract Act (SCA) applies to this solicitation for law enforcement/force instructional services. The class of service employee expected to be employed under the BPA is, "Instructor." Wage determinations for each Fleet Concentration Area are attached hereto. Colleges, universities and accredited institutions are probably exempt from SCA, however, please be advised that the Navy does not interpret the classification of contractor's employees. It is the responsibility of the contractor to determine if their employees are exempt or not. FAR Clause 52.222-41 is added to this solicitation and to the sample Blanket Purchase Agreement. Question 1: Does the contractor have to perform Physical Training Curriculum as per LE TCCD? Answer: No, the contractor does not have to perform the Physical Training curriculum in the Law Enforcement TCCD. Question 2: Does the sequence of courses in the LE TCCD have to be adhered to or can they be rearranged in modules to support logistical requirements? (Still maintaining a logical training sequence). Answer: Yes, the contractor may change the sequence of training modules to meet logistical requirement, but must still maintain a logical training sequence. Any changes to the curriculum or curriculum sequence must first be coordinated with the LTA. Question 3: How do we document or test to ensure that instructors meet the physical fitness standards for Force Protection courses? Is that part of the Navy certification process? Answer: Contractors will self certify that their instructors meet the physical fitness standards for Force Protection as well as the height and weight requirements under the Law Enforcement course. If the Navy certification team notices a discrepancy during the instructor qualification process they may challenge the instructors physical fitness. It will remain the contractor's responsibility to remedy the situation. Reminder, the physical fitness level of the instructor is to protect the instructor and Navy student during strenuous physical activity whether required in Force Protection or Law Enforcement activities.
