Description

The Broadcasting Board of Governors, International Broadcasting Bureau intends to solicit, negotiate and award a firm-fixed-price (FFP) contract on a non-competitive basis to Bits Per Second 4 (BPS4) to provide replacement on-line cards and spare parts for the Lighthouse switch cards that were used at the Greenville Transmitting Station (GTS) and for the IBB Network Control Center's Middle East switch, with an option to purchase additional spares. The statutory authority permitting other than full and open competition is FAR Subpart 6.302-1(a)(2), 41 USC 253 (c)(1), which states: "When supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy agency requirements. Lighthouse, the manufacturer of the switches has transferred the sole rights to distribute these switches to Bits Per Second 4 (BPS4). Full and open competition need not be provided for and FAR Subpart 6.302-2(a)(2) unusual and compelling urgency. This Lighthouse on-line cards and spares are needed on an urgent basis to replace the cards used at GTS and for the Middle East switch. If the agency were to compete this requirement it would delay a contract award and would result in serious harm to the agency's mission. FOB: Destination. Numbered Note 22.=20
