- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR subpart 12.603, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation and a written solicitation will not be issued. RFQ Reference Number 02-897-2054 is issued under FAR Part 13, Simplified Acquisition Procedures. Quotes are requested. The RFQ incorporates provisions and clauses in effect through Federal Acquisition Circular 2001-2. The National Institute of Standards and Technology (NIST) has a "BRAND NAME OR EQUAL" computer requirement for a Quantity of 5 forensic systems to be used in the Computer Forensics Tool Testing Project to test forensic software tools, similar in type to computers used for criminal investigations. Quotes may be submitted for EITHER the Brand Name specified herein OR items manufactured by other company(ies) that meet all the salient, physical, functional, and performance characteristics. Brand name or equal descriptions are intended to be descriptive, not restrictive, and are intended to indicate salient characteristics of products considered to satisfy the RFQ requirement. The vendor shall deliver all line items FOB Destination to NIST, 100 Bureau Drive, Building 301, Shipping & Receiving, Gaithersburg, MD 20899-0001. Desired delivery time is 8 weeks from date of award. The Government will award a purchase order to the responsible offeror whose offer conforms to the solicitation and is most advantageous to the Government, price and other factors considered. The following factors in descending order of importance shall be used to evaluate offers: (1) Technical Capability to Meet the Government's Needs; (2) Past Performance; and (3) Price. The provision at 52.212-2, Evaluation-Commercial Items, applies to this acquisition. The clause 52.212-4, Contract Terms and Conditions-Commercial Items applies to this acquisition. The clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, and Department of Commerce Agency-Level Protest Procedures Level Above the Contracting Officer, which can be downloaded from the NIST Web Page located at http://www.nist.gov/admin/od/contract/protest.ht apply to this acquisition. All offers shall submit the following: (1) Three (3) copies of quotation which address each CLIN; (2) Technical description and/or product literature; (3) Description of commercial warranty; (4) Two (2) copies of the most recently published price list(s); (5) A list of three (3) contracts completed during the past three (3) years for a similar requirement with the following information: name of contracting activity, contracting officer, contract number, total contract value, contract type, telephone number; and (6) a completed copy of the provision 52.212-3, Offeror Representations and Certifications-Commercial Items which may be downloaded from http://www.nist.gov/admin/od/contract/repcert.htm.
