- IBM, Corp. COGNOS Software Maintenance Renewal This posting is to inform about the Sole Source purchase of COGNOS Software Maintenance Renewal from International Business Machines Corporation. The Contract number is FA8604-10-M-7467. This award notice and incorporated clauses/provisions are those in effect through Federal Acquisition Circular Fac 2005-33, Effective 15 Jul 2009 includes Fac 2005-34, Effective 01 Jul 2009, and DFARS Current to DCN 20090115 Edition. This is a sole source requirement IAW FAR 6.302-1. WPAFB intends to award to International Business Machines Corporation of Yorktown Heights, NY 10598-0218. Authority: 10 U.S.C. 2304(c)(1), Justification: Supplies (or Services) required are available from only one or a limited number of responsible source(s) and no other type of supplies or services will satisfy agency requirements. This solicitation incorporates the following clauses by reference: Federal Acquisition Regulation (FAR)52.204-7, 52.212-1, 52.212-3, 52.212-4, 52.212-5, Department of Defense FAR Supplement (DFARS)252.204-7004 - Alternate A, 252.211-7003, 252.212-7001, 252.227-7013, and 252.227-7014. This solicitation incorporates the following clause in full text: Air Force FAR Supplement (AFFARS)5352.201-9101 OMBUDSMAN (AUG 2005) (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). (c) If resolution cannot be made by the contracting officer, concerned parties may contact the Center/MAJCOM ombudsmen, Mr. Howard E. (d) The ombudsman has no authority to render a decision that binds the agency. Delivery is FOB Destination. Period of Performance will include one base year and four one-year option periods.
