Description
This is a combined synopsis/solicitation for commercial products or commercial services prepared in accordance with the format in subpart 12.6 of the Federal Acquisition Regulation (FAR), as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation HQC00422Q0030 is issued as a request for quotation (RFQ). This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2023-01 dated 12/01/2022. This requirement is being solicited as a 100% small business set-aside under the North American Industry Classification System (NAICS) code 322220 with a small business size standard of 750 employees. Description of Supplies/Services: This requirement is for the acquisition of direct thermal print labels to be delivered to all Defense Commissary Agency stores located in the continental United States, Alaska, Hawaii, Far East, and Puerto Rico. See the Direct Thermal Print Label CLINS spreadsheet (attachment 1) for a description of the required products, the contract line item numbers, and an estimated quantity of each item per year. The ordering period for this requirement is anticipated to be March 17, 2023 � March 16, 2024 with the consideration of up to four option years. An indefinite delivery, indefinite quantity contract is expected for this requirement. In accordance with FAR 16.504, the minimum and maximum ordering quantities are one of each item listed in attachment 1 and 60,000 total units respectively. The contractor will be required to deliver to the requesting commissary store and accept payment by a Government Purchase Card (GPC). Orders delivered will be inspected by the store receiving the delivery. Delivery is required 30 days after receipt of order. Delivery to commissaries shall be made between the hours of 7:00 am and 3:00 pm local time, Monday through Friday, excluding official Government Holidays. The contractor can find the delivery address and point of contact information for each store at www.commissaries.com. Each commissary will be ordering on a monthly basis. Delivery to CONUS, Alaska and Hawaii shall be to the requesting commissary. Delivery to Far East locations shall be to the Point of Embarkation (Coastal Pacific, Stockton, CA). Delivery to Fort Buchanan (Puerto Rico) shall be to the Point of Embarkation (MDV Nash Finch, Norfolk, VA). The submitted quote must reflect FOB destination for all items and delivery locations. There is no commitment by the Government to issue a RFP, make award(s), or to be responsible for any monies expended by industry responses to this RFQ. Quote is due by March 03, 2023, 4:00 PM EDT. Additional Information 1. ELECTRONIC DOCUMENT ACCESS (EDA): This award document and any subsequent modifications will be posted to the Department of Defense Electronic Document Access (EDA) system. PAYMENT Payments will be made by Government Purchase Card (GPC) (Credit Card). Authorized ordering officers are defined as DeCA employees that are GPC holders located at the Commissary stores or CDCs. 3. INTERNET-BASED ELECTRONIC ORDERING The contractor is required to have an internet-based electronic ordering process/system in place within 30 days of notification of award. As a minimum, the proposed web-based system must offer the following: The contractor�s internet-based ordering system will list each item by DeCA item number, include a brief description, thumbnail image, and unit price. The contractor shall provide authorized ordering officers with a password or Personal Identification Number (PIN) at time of registration for the ordering website. The Contractor shall have office procedures as well as up to date web-based security software that is Payment Card Industry compliant, in order to keep GPC safeguarded and secure. Quoters must provide a statement from their servicing bank verifying this standard is being met prior to implementation of the internet-based system. This verification letter must be dated within one year prior to the quotation due date stated above. Orders will be placed electronically, in accordance with the line items identified on the contract, by authorized individuals. The contract awardee will assign each order a unique purchase request number. Order history shall be accessible by authorized users for a minimum period of 90 days after placement or order. The contractor shall have the ability to accept or reject orders based on invalid credit card information, or failure to meet minimum order amount as stated in 52.216-19, Order Limitations. Within one business day of order placement, the contractor shall provide ordering/store personnel an electronic confirmation/acknowledgment for each order. Notification shall include at a minimum, the following information: date of order, purchase request number, line items and quantities, total amount of order, and estimated shipping date. Backordered items shall be acknowledged as follows. The quoter will provide a point of contact, with phone number and email address, that will be used by the commissary or DeCA contracting to receive regular updates on the backordered items. Once the entire order has shipped, the contractor is authorized to charge the credit card for the appropriate amount. The purchase request number for the appropriate order must be entered so that it will appear in the secondary data field, this ensures that the charge can be easily identified on the Government�s credit card statement and can be matched to the applicable order. Delivery to the requiring commissary shall be within 30 days after electronic confirmation of each internet-based order. Upon receipt of the item(s) at the store a physical inspection will be performed. Items found not in compliance with the terms and conditions of the contract will not be accepted. Rejected items will be replaced at no additional charge within 7 days of rejection. Nonconforming products discovered after acceptance must be replaced within 14 days of notification. At the time of notice of non-conformance, the contractor may request that items be returned at the contractor�s expense. Nothing in the prohibition shall be construed to� ��������������� (i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or ��������������� (ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles. ���������� (2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to� ��������������� (i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or ��������������� (ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles. ����� (c) Procedures. The Quoter shall review the list of excluded parties in the System for Award Management (SAM) ( https://www.sam.gov) for entities excluded from receiving federal awards for ""covered telecommunications equipment or services"". ����� (d) Representation. The Quoter represents that� ���������� (1) It ? will, ? will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Quoter shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Quoter responds ""will"" in paragraph (d)(1) of this section; and ���������� (2) After conducting a reasonable inquiry, for purposes of this representation, the Quoter represents that� ��������� It ? does, ? does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Quoter shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Quoter responds ""does"" in paragraph (d)(2) of this section. ����� (e) Disclosures. (1) Disclosure for the representation in paragraph (d)(1) of this provision. (End of clause) Addenda to clauses or provisions 52.212-4 Addendum ADDENDUM TO FAR 52.212-4 CONTRACT TERMS AND CONDITIONS � COMMERCIAL ITEMS The following paragraphs have been changed/added to FAR 52.212-4 Terms and Conditions � Commercial Items. (a) Inspection/Acceptance. Orders delivered will be inspected by the store. Delivery is required 30 days after receipt of order. Delivery to commissaries shall be made between the hours of 7:00 am and 3:00 pm local time, Monday through Friday, excluding official Government Holidays. The contractor can find the delivery address and point of contact information for each store at www.commissaries.com. CHANGES. Unilateral Modifications The Government may issue unilateral written administrative modifications that do not affect the substantive rights of the parties. Examples of administrative modifications are corrections in the payment office address, changes to the accounting and appropriation data, or addition of funds. Bilateral Modifications Items may be added to or deleted from this contract. Any replacement or additional items must be added to this contract prior to any GPC purchase being completed on the contract. Additions and/or deletions of items will be accomplished by bilateral modification. GPC purchases performed outside the dates or scope of this contract will not be reimbursed by the Government. All labels, as described in the Direct Thermal Print Label CLINS attachment, shall be available for order at any time throughout the period of this contract. Design changes, as well as additions, or deletions of any label shall not be made without the written consent of the contracting Officer through a bilateral contract modification.
